What has changed?
No Tax Fee on Regulated Items
The One Big Beautiful Bill Act reduced the federal making and transfer tax to $0 for short-barreled rifles (SBRs), short-barreled shotguns (SBSs), silencers/suppressors, and "any other weapons" (AOWs).
No Mandatory NFA Approval & Registration
Following a federal district court injunction (Silencer Shop Found. v. ATF), the ATF established a uniform nationwide enforcement policy. Effective October 9, 2026, the ATF no longer requires individuals to obtain prior ATF approval or register these $0-tax items in the National Firearms Registration and Transfer Record (NFRTR) before making or transferring them.
Between August 12 and October 8, 2026, non-registration transfers of $0-tax NFA items (like suppressors) were limited strictly to members of plaintiff organizations (e.g., Silencer Shop Foundation, GOA, FRAC) or items purchased through specific approved co-plaintiff dealers. Under the ATF's October 9 guidance, the agency adopted a uniform nationwide policy, removing all membership and specific seller requirements. Standard over-the-counter purchases can now be made by any eligible person at any Federal Firearms Licensee (FFL) through proper completion of a 4473 and approved background check.
Voluntary Submissions are Accepted
ATF will still process standard forms (Forms 1, 2, 3, and 4) on a voluntary basis for those who choose to submit them.
What has not changed?
Machineguns & Destructive Devices
The $200 tax was maintained for machineguns and destructive devices, so all standard NFA registration and approval requirements still apply.
Gun Control Act (GCA) Rules
All items remain classified as "firearms" under the GCA. Prohibited persons are still barred from possession, and standard FFL recordkeeping and background check requirements remain fully enforced.
Interstate Transport
Form 20 filings are still required for transporting SBRs and SBSs across state lines.
State & Local Law
Federal enforcement changes do not override state or local legal restrictions or bans on NFA items.
